Foster S.B. Friedman — the drafting attorney behind both the Pierre Paul Gagnon Trust and the Gaetane Gagnon Trust — is in the process of disinheriting Valérie Gagnon, the only beneficiary, the sole surviving child of his own client. He controlled both documents. He controlled both clients. He is the architect of what follows. Remember that name.
Mr. Hatch — we know how your Legacy Society operates. We know that estate attorneys are recruited — directly or indirectly — to insert FINCA International as a named beneficiary in trust documents. We know that FINCA International has built an entire planned giving infrastructure designed to capture estate assets. We are not here to educate you. We are here to tell you that we have documented how that infrastructure is being exploited by unscrupulous actors — and we will expose it.
Neither Gaetane Gagnon nor Pierre Paul Gagnon had ever heard of FINCA International before it appeared in this trust. We belong to a large extended family. There are many people who could have been named. There are many causes that mattered to this family. And yet — under the trust drafted by Foster S.B. Friedman — if Valérie Gagnon were to die, your non-profit would become the sole beneficiary of the entire estate. Not family. Not a charity either parent ever chose. FINCA International. Inserted by the attorney. And who would know to fight this? We live abroad. Who would be there to ensure that pledge ever reached your non-profit — and not one of your board members’ grandchildren?
Friedman drafted both trusts with absolute discretionary power vested in himself as trustee. That structure gave him unilateral control over every asset — every decision, every distribution, every dollar — with no checks, no accountability, and no obligation to the rightful heir. He did not draft a trust. He drafted a takeover. Valérie Gagnon, the only beneficiary, has been locked out of her own inheritance by the attorney her father trusted to protect it.

Mr. Hatch — ‘Planned Giving’ is an elegant phrase. It sounds generous. It sounds dignified. It sounds like a donor making a thoughtful, voluntary choice to leave a legacy. That is what it is supposed to sound like. We are here to tell you what it actually looks like on the ground — when unscrupulous estate attorneys exploit your infrastructure to insert FINCA International into trust documents without the knowledge or consent of the people whose assets are at stake.
The elderly are the target. They are vulnerable. They rely on the attorneys who draft their documents. They trust the professionals around them. Many are ill, isolated, abroad, and unable to verify what is being done in their name. Your Planned Giving program — your Legacy Society — creates a direct financial incentive for estate attorneys to name FINCA as a beneficiary. That incentive has no mechanism to verify that the donor ever chose FINCA. It has no requirement that the donor be informed. It has no safeguard against abuse. It ends with a check.
Foster S.B. Friedman inserted FINCA International as a named beneficiary into a trust document when the settlor was obviously stricken by dementia. He exploited the cognitive vulnerability of the very person who trusted him to protect their estate. That is elder financial abuse. And your Planned Giving Program made it possible.
Your Legacy Society built a system. Your Planned Giving Program weaponized it against the very people you claim to serve.
Mr. Hatch — your Legacy Society’s Planned Giving Program has no lock on the door. No verification that the donor ever chose FINCA International. No confirmation that the elderly person whose assets are at stake was ever informed. No audit trail. No safeguard. Nothing standing between your organization’s name and the most predatory estate attorneys in America. Your Planned Giving Program handed them a weapon and called it charity. Every unscrupulous actor who has ever inserted FINCA International into a trust document without the donor’s knowledge walked through a door your Planned Giving Program built and left wide open. You are not innocent. You are negligent. And negligence at this scale — when the victims are elderly, isolated, ill, and abroad — has a name. It is called a crime.
FOUR DEMANDS — RESPONSE REQUIRED WITHIN 14 DAYS
1. Conduct an immediate internal investigation into FRIEDMAN, GRIMES, MEINKEN & LEISCHNER PLLC’s relationship with FINCA International and its Legacy Society — including the Friedman family connections documented in FINCA’s own annual reports and donor lists.
2. Produce all records showing how FINCA International came to be named as a beneficiary in the Pierre Paul Gagnon Trust.
3. Confirm in writing that NEITHER Gaetane Gagnon NOR Pierre Paul Gagnon had never contacted nor donated to FINCA International before it appeared in the trust.
4. Formally disclaim FINCA International’s interest in the Pierre Paul Gagnon estate.
WHAT HAPPENS IF YOU DO NOT RESPOND
Because if you do not act now, you and your foundation will be implicated in a scheme to defraud elderly people of their wealth by all legal and illegal means possible. And we will expose you. When the public understands that FINCA International’s ‘Planned Giving’ program created the infrastructure that made this possible — you will not only lose your foundation’s reputation and its donors. You may lose your freedom.

Everything that i know about FINCA and it’s attemp to disinherite my extended faily will be exposed. It will rank for FINCA International’s name. It will be there when your donors search for you. It will be there when your board members search for you. It will be there when journalists search for you.
Everything we know about FINCA’s planned giving infrastructure, Foster S.B. Friedman, the Friedman family connection to FINCA International, and Maître Olivier Morin’s fraud vehicle assessment will be on that site. Permanently.
